Great day for the firm and our clients yesterday. Criminal trial in the morning in Fredericksburg, and Civil Motions in Prince William County in the afternoon. Although thoroughly prepared to put on our case in chief, we won the morning trial on the Motion to Strike. Then with a quick stop at the office to walk Ranger, I made it to Prince William County with a few minutes to spare, and after 2 and 1/2 hours of argument and deliberation, where the judge initially stated he was going to rule against us, we convinced him of the righteousness of our cause and that the caselaw supported our pathway to seeking restitution.
The Defense Team can no longer delay justice. It is time to set this case for a week-long trial.
Two completely different cases, two thrilled clients. Double victory.
But we are not resting on those victories. My takeaway is that my written briefs in the afternoon civil case could have been clearer. Luckily, we had a very clear-minded jurist who, although he had read the briefs prior to the hearing and decided against us, took the time to listen to the arguments and made the right decision based on the law.
